In terms of the number of people participating and the time and expense required
to litigate, products liability cases are the “biggest” personal
injury cases that can be litigated. Products liability cases tend to be “big” because
one product distributed by a manufacturer may be consumed by thousands of
people and, if that product is defective, some or all of those people may
be injured. In response, all of those people file claims against the company
and the company is required to litigate the safety and suitability of the
product over and over again.
Over the course of repetitious litigations pertaining
to the same product, the company and its lawyers will become very
adept and efficient at defending their product and defeating any
one individual Plaintiff’s claim. Increasingly, Defendants
are being allowed to join all prospective Plaintiffs into one federal
class action lawsuit or multi-district litigation which may affect
the rights of Plaintiffs who have not even filed a lawsuit. Because

believes that the product is still economically viable), companies
